The Failure of the 28-Article Peace Proposal for Ukraine: How Peace Negotiations Continue to Stumble

Europe experienced widespread relief on Monday, as the crisis triggered by the announcement of a new 28-point plan for resolving the conflict appeared – momentarily – to have been defused. A American diplomat spoke of "significant advancement" after bilateral negotiations in Geneva. On Monday night, Moscow made its response: an extensive attack of aerial bombardment on Kyiv.

The Cycle of Peace Talks and Military Action

The succession of conflicting incidents captured the bleak nature of the recent timeframe. By day, political struggles are fought: positive announcements are released from multiple capitals. Immense energy is expended on managing specific proposals. By night, Moscow brutally reminds the world that, for them, conflict continues to be the primary tool for achieving "resolution".

Nocturnal Warfare

As the offensive unfolded into the early hours of Tuesday, the current condition of Ukraine's exposure was revealed. Ukraine is capable of detecting missile launches from across the border, a capability enabled by up-to-date information. From vantage locations, defense planes that had been scrambled to counter approaching aerial threats streaked across the sky – advanced fighter aircraft delivered to Ukraine by European allies.

Shortly after, Kyiv's air-defence systems engaged: multiple launches fired to intercept a Russian ballistic missile. This was a advanced protection mechanism at work, presumably provided by Western nations. Every firing shakes the surroundings, rattling buildings. The brief panic quickly becomes grim resignation: perhaps the hostile projectile won't cause damage this time, preventing destruction from catastrophe and another blackout.

Persistent Threats

Following this, a heavy machine gun engaged a unmanned aircraft close by, part of a rapid response unit – most likely imported technology. Unfortunately, the projectiles didn't strike the opposing UAV – it maintained course toward its target.

With pauses, this continued until dawn. Kyiv faced the early updates: multiple fatalities, devastation and infrastructure problems in multiple buildings as a result of the evening attack. As always, everyone still went about their day – living the war. But those 24 hours encapsulated Ukraine's vital need on Western support – a reliance that regional partners are evidently unprepared to substitute in the short term.

Failed Diplomacy

The comprehensive proposal from American leadership provoked deep reactions, discussion and deep concern – and temporarily diverted attention from Ukraine's major integrity crisis in years. Yet, we have seen this script before, after earlier high-level meetings and bilateral conferences.

Every new proposal from Washington adheres to the same pattern: a negotiation push against Ukraine, which Kyiv, with allied governments, effectively counters. They contain the crisis but never actually win the battle. This cycle will, certainly, continue.

Strategic Calculations

It is easy to blame certain parties of persistently promoting Russian terms. But that does not seem to be the whole story. US administration functions according to a principle familiar among seasoned negotiators: you cannot win at the negotiating table what you have been unable to protect through force. The American government believes that it is unrealistic to compel Moscow to surrender the land that it currently occupies in Ukraine's southern or eastern regions.

The challenge is that while accepting these circumstances, US leadership does minimal to deter Moscow, through words or deeds, from assuming that the situation will not shift further in its benefit in the coming year.

Divergent Views

Therefore, Moscow is convinced that duration works to their advantage – that Ukraine and its allies are coming close to fatigue. Their reason to accept conditions that does not give them the maximum possible gain is almost completely absent. There may be many attempts to stop fighting, but they will continue as long as Russia's leadership remains supremely confident in the result.

On the contrary, Ukrainian leadership believes that Ukraine can still endure, slowly losing civilians and areas but preventing a entire defensive failure until conditions improve in its benefit.

Existing Situation

Realistically, there are no actual prerequisites for a ceasefire. Now, personal considerations are entering the equation: personal goals to mediate resolution and achieve global acclaim, and the government's dual difficulties – on one hand, not to alienate a key ally, and on the other, to unite the population around the national cause against any plan Kyiv finds unsuitable, so that their attention does not shift toward homefront challenges. And although their task will now be considerably more difficult after recent developments, it remains highly unlikely that this will alter their fundamental strategy.

These opposing factors are guiding negotiations.

Assessment and Future

It took a mere seven days to eliminate the proposed articles of the most recent proposal. Assertive and inconsistent approach of the matter by Washington, pushback by Ukraine and the rest of Europe, along with calming attempts of negotiators, and finally, latest revelations, all served their function.

While new proposals based on established approaches are imminent, Kyiv, London and other Western governments should arrive at a critical understanding: Ukraine and Europe will only be able to resist negotiation assaults from Washington that are based on Russian demands and show certain reluctance to alter the situation, if they remain united and strengthen their defence capabilities at a much faster pace. If they do, no combination of diplomatic or military actions will be able to break them. In the meantime, Ukraine's capacity to defend against evening bombardments will, for the foreseeable future, primarily depend on sustained allied backing.
